The AWR has been branded the biggest change in the recruitment industry since the conduct of employment agencies and employment businesses regulations which came out in 2003. New Millennia understand the importance of applying the agency workers regulations (AWR) to ensure that the principle of equal treatment – which already applies to fixed-term and part-time workers – is extended to agency staff once they have completed a 12 week qualifying period – however this does not mean that temporary workers are not entitled to the same working conditions from the start date of the assignment.
Although equal treatment does not fundamentally affect employment status or the dynamics of how agency staff are placed and managed, it does cover "pay" and "working conditions".
E.g. "A Worker starts a new assignment on 1st October 2011. From that date the worker is entitled to use any staff canteen, childcare or transport facilities. The worker works continuously for 12 weeks in that assignment. From week 13, the worker is also entitled to receive equal treatment in terms of pay and working conditions in comparison to the clients own directly engaged staff".
There are a few compliance measures which can be considered depending on the type of labour supplied, contract with the end client and duration of the contract. More information will be made available once the guidance has been released (due in April 2011) by the Department of Business, Innovation and Skills (BIS).
